Kmart Kenny Chesney Summer in 3D Sweepstakes

NO PURCHASE NECESSARY. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED TO ENTER.  Kmart Kenny Chesney Summer in 3D Sweepstakes (“Sweepstakes”) begins on 5/9/10 and ends at 11:59 PM CDST on 6/20/10.

ELIGIBILITY: Open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are 18 or older at the time of entry, excluding employees of Sears Holdings Management Corporation (“Sponsor”), its respective parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies (collectively, “Released Entities”), and the families and/or household members of each of the above. Sweepstakes void in Alaska, Hawaii and where prohibited.

HOW ENTER: The Sweepstakes consists of seven (7) Entry Periods (each an “Entry Period”) as indicated in the chart below. To enter during any of the Entry Periods, go to www.kmart.com/kennychesney and follow the onscreen instructions to register on the website. To earn additional Entries into the Sweepstakes, submit a valid email address and first name of any individual you believe would be interested in receiving information about from Kmart.com. You will receive one (1) additional Entry into the Sweepstakes for each unique and valid email address you submit. You will not receive additional Entries if you submit an email address for an individual that has been previously been submitted by you or for any invalid email address you submit. Limit up to six (6) entries per person per email address per day. All Entries for a given Entry Period must be received by 11:59 PM CDST on the deadline date of such Entry Period as indicated in the chart herein. Sponsor is not responsible for lost, late, damaged, misdirected, illegible or incomplete entries, all of which are void. Entries become Sponsor’s property and will not be acknowledged or returned. Use of automated devices are not valid for entry. Any Entry that is submitted with the use of an automated device will be void.

SEVEN (7) RANDOM DRAWINGS: Seven (7) Random Drawings (“Random Drawings”) will be conducted from among all eligible entries received by the corresponding Entry Period deadline date as indicated in the chart below. Odds of winning a Prize will depend upon the number of eligible entries received during each Entry Period stated herein. All Random Drawings will be conducted by Centra Marketing & Communications, LLC. an independent judging organization whose decisions on all matters relating to this Sweepstakes are final and binding. All Random Drawings will be conducted on or about one (1) business day following the end date of each Entry Period as indicated below. Limit one (1) prize per household. Potential Grand Prize and First Prize Winners will be notified by overnight Mail delivery on or about two (2) days after the corresponding Drawing Date. All other Prize Winners will be notified by U.S. Mail, email, telephone at Sponsor’s sole discretion on or about five (5) business days after the corresponding Drawing Date.

TOTAL APPROXIMATE RETAL VALUE OF ALL PRIZES: $7,175.

PRIZE DESCRIPTIONS: One (1) Grand Prize: Grand Prize is a trip for Grand Prize Winner and one (1) guest to Las Vegas, NV to attend the Kenny Chesney Concert on July 3, 2010 and a “meet and greet” session with Kenny Chesney. Grand Prize consists of round trip coach air transportation between major commercial airport nearest Grand Prize Winner’s residence and Las Vegas, NV, two (2) nights’ hotel accommodations (double occupancy room and tax only), two (2) tickets to the Kenny Chesney Concert scheduled on July 3, 2010 and the opportunity to “meet and greet” Kenny Chesney. Airline, hotel and concert seating will be designated by Sponsor. Grand Prize Winner must depart on July 2, 2010 and return on July 4, 2010. In the event the Grand Prize Winner cannot travel on dates designated by Sponsor, Grand Prize Winner will be disqualified and an alternate winner will be selected in a random drawing from among all remaining eligible entries provided sufficient time remains prior to the Kenny Chesney concert. In the event the Grand Prize Winner resides within 150 miles from Las Vegas, NV, Grand Prize Winner will receive one (check made payable to the winner’s order in the amount of $300 for use of his/her vehicle, tolls, gasoline and parking in lieu of the air transportation. Actual value of Grand Prize may vary based on airfare fluctuations. In the event the designated Guest is deemed a minor (under applicable state law), such Guest’s parent or legal guardian must sign and return all required documentation. All Grand Prize travel is subject to terms and conditions and availability. Grand Prize travel must be round trip. Sponsor will determine airport of departure and flight itinerary in its sole discretion. No refund or compensation will be made in the event of a cancellation or delay of any flight. All expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to, ground transportation not stated herein, meals and beverages, incidentals, upgrades, baggage fees, gratuities, passenger tariffs or duties, surcharges, airport fees, travel documents, service charges or facility charges, personal charges at lodging, security fees, taxes or any other expenses are the sole responsibility of the Grand Prize Winner. Grand Prize Winner will be required to provide a valid credit card upon hotel registration for all personal incidentals charged to the Grand Prize Winner’s hotel room during his/her stay and Grand Prize Winner will be solely responsible such hotel charges. Travel restrictions, conditions and limitations may apply.  Grand Prize Winner and Guest must travel on same itinerary. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. Grand Prize Trip is subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security as required. Sponsor is not responsible for any fees or additional charges resulting from Prize Winner or Guest changes to flight itinerary or accommodations. Grand Prize Winner and Guest are solely responsible for their own travel insurance. Four (4) First Prizes: Each First Prize consists of two (2) tickets to the Kenny Chesney concert in Las Vegas, NV on July 3, 2010 and a “meet and greet” session with Kenny Chesney. Each First Prize Winner will be solely responsible for any and all costs for air transportation, ground transportation, lodging, gasoline, tolls, parking, meals and any other personal incidental charges required to travel to the Kenny Chesney concert. In the event the Kenny Chesney concert is cancelled or postponed for any reason that portion of the Grand Prize or the First Prizes will not be provided and Sponsor will not provide any additional compensation in lieu of the cancelled concert or “meet and greet” session. The Movie Posters, Baseball Caps, Cowboy Hats, Movie Light Tran and Guitar will be designated by Sponsor. Any difference between the stated approximate retail value and the actual value of any prize will not be awarded.

PRIZE ACCEPTANCE: Prizes are not transferable. No prize substitutions or cash redemptions allowed except by Sponsor, who may substitute a prize of equal or greater value if an advertised prize becomes unavailable. All federal, state and local taxes are the sole responsibility of the Prize Winners. Grand Prize Winner will receive a 1099 IRS tax form at year end for the actual retail value of prize.  Grand Prize Winner will be required to sign an Affidavit of Eligibility/Prize Acceptance/Release of Liability and Publicity (where permitted) within a time period designated by Sponsor, or prize may be forfeited. All First Prize Winners, and Prize Winners of a Movie Poster, Baseball Cap, Cowboy Hat, Movie Light Tran or a Guitar will be required to sign and return a Prize Verification Form within a time period designated by Sponsor or prize may be forfeited. Non-compliance will result in disqualification of such potential Prize Winner and if the potential Prize Winner is a Grand Prize or First Prize Winner, the prize will be awarded to an alternate winner in a random drawing from among all remaining eligible entries received provided sufficient time remains prior to the Kenny Chesney Concert. In the event a prize winner of a Movie Poster, Baseball Cap, Cowboy Hat, Movie Light Tran or Guitar is disqualified, that prize will be awarded to an alternate winner in a random drawing from among all remaining eligible entries. By signing and returning an Affidavit of Eligibility, Liability and Publicity and Travel Release, or a Prize Verification Form, each Prize Winner provides permission to Sponsor to use his/her Entry, name, hometown and/or likeness/photograph for promotional, advertising and/or publicity purposes in any media, known or hereafter invented throughout the world in perpetuity, without further notice or compensation and to be subject to a personal background check, except where prohibited by law. Sponsor will make two (2) attempts to notify a Potential Prize Winner at the email address submitted at the time of entry.  If a Potential Prize Winner cannot be reached, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification or any prize correspondence is returned as undeliverable, that Potential Prize Winner may be disqualified and that Prize may be awarded to an alternate winner in a random drawing from among all remaining entries. Guest of Grand Prize Winner will be responsible for signing and returning an Affidavit of Eligibility, Liability and Publicity and Travel Release (where permitted) within a time period designated by Sponsor. Any Prize won by a minor (under applicable state law) will be awarded in minor’s name to a parent or legal guardian, who will be required to sign all required documents.

CONDITIONS OF PARTICIPATION: By submitting an entry, you warrant that you are a legal resident of the United States of America (excluding Alaska and Hawaii) and not: i) represented under a contract (e.g., by a talent agent or manager) that would in any way limit or impair Sears’ ability to display or use your name, likeness, or any work that you have created in any media form; ii) subject to an acting, modeling, or any other contract that would make your appearance in the work a violation of any third-party rights; or iii) under any other contractual relationship, including but not limited to any guild or union memberships, that may prevent Sears from being able to use the work or image worldwide in all media in perpetuity on a royalty-free basis, without any payment or fee obligations of any kind. By participating in the Sweepstakes, each Prize Winner agrees to release Sponsor and its parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Sweepstakes or with respect to awarding, receipt, possession, use and/or misuse of any Prize. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion via mobile phone.  If for any reason, this Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right to select winners from eligible entries received as of the termination date.  Sponsor further reserves the right to disqualify any individual who tampers with the entry process. By entering the Sweepstakes, each entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out?of?pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event will attorneys’ fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and each entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out?of?pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. By entering and participating, entrant agrees to defend, indemnify and hold harmless the Released Entities from and against any and all claims, demands, liability, damages or causes of action (however named or described) losses, costs or expenses, with respect to or arising out of or related to: (i) entrant’s participation in the Sweepstakes, and (ii) entrant’s acceptance, use or misuse of a prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)). Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of a prize. In the event the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prizes from among all valid and eligible entries received up to the time of such Force Majeure event.
